THE trial of former Bulawayo mayor, Joshua Malinga facing charges stemming from a police officer's use of Shona language in a predominantly Ndebele city has been postponed to next year after his lawyer made an application that he would not be available. And there has been some siginificant developments with prosecutor Mr Evans Mungoni removed from the case and replaced by Ms Siphiwe Tshabalala.
He is now facing charges of contravening Section 177 (b) of the Criminal Law (Codification and Reform) Act, Chapter 9:23. Mr Job Sibanda, of Job Sibanda and Associates, who is representing Malinga, told Bulawayo magistrate, Miss Sithembiso Ncube that he would not be available for the trial and it was agreed that Malinga would now go on trial on 8 January. It is alleged that on 11 February this year, at around 10 am, Constable Raphael Somerayi approached Malinga in Shona language much to the former mayor's exasperation outside the High court buildings. It is said Malinga had parked his vehicle at the corner of 8th Avenue and Herbert Chitepo Street with its tail allegedly encroaching into the road thereby blocking other cars. Const Somerayi approached Malinga and spoke to him in Shona requesting him to park properly. Police who constructed a case against the former mayor are alleging that Malinga responded by insulting the complainant in English saying: "You are stupid, idiot officer speaking Shona in Matabeleland". The police officer requested to see his drivers' licence but Malinga allegedly refused with it saying there was no law that forced him to carry it on his person. Malinga allegedly threatened to put the police officer in "hot soup" for interrupting him. The officer requested him to accompany him to Tredgold Building to see his superiors if he (Malinga) was offended by his use of the Shona language. At the Tredgold Court section, Assistant Inspector Tendekayi Murehwa, who is also a public prosecutor, attended to Const Somerayi and Malinga. The State alleges that Malinga continued with foul words and said, "He is a stupid, idiot police officer who speaks Shona in Matabeleland". Malinga had his application for referral of his case to the Supreme Court dismissed in September and thereafter the trial has been postponed on numerous occasions and at one stage it was because the prosecutor who had been dealing with the case, Mr Mungoni, had been moved from Court Seven. Ms Siphiwe Tshabalala is now taking over from Mr Mungoni. When he was mayor, Malinga was embroiled in heated debate with the government's lack of development in Bulawayo and deployment of Shona speaking teachers to Matabeleland's primary schools. Malinga who also became a target of the notorious CIO also queried why local instititutions of higher learning were being led by people from outside the region. When he was Information minister, Jonathan Moyo also ended the Zimpapers policy that no Ndebele journalist should be editor.

I am a Mbire myself and I can promise you that this MuMbire thinks he is Mbire when he is something else. The Mbire people are Royal and they talk Royal language full of unifying facts. How ever we are so good that people take advantage of us and bring possesed children from other demonic families and call those children ours.

For a grown up like Malinga to call someone stupid coz he spoke to him in Shona is very idotic. He qualifies to be called an imbecile, an Idiot. If those whose comments above feel is right then you are lost! This is Zimabwbe and everyone is free to use whatever language they feel like using.

If you disagree with an elder or if you feel offended by the same, there is no provision in African culture to refer to an elder as an imbecile.
If an elder makes you angry, call me the imbecile or donkey. Like if you walk in a London Street and an elder offends you, you must say "Mweni is a real donkey!!". I will feel good not by being called donkey, but by your abstaining from insulting an elder.

If those who claim to be Christians end up doing such taboos, there could be fundamental problems with Christianity in that:
1) Jesus is known to have dishonoured his mother when she had approached her during his time
2) If you worship a man like me what level of goodliness do you expect your worshipping of the son of Joseph to reach you?
2) Human sacrifice and the use of human blood has nothing to do with the worshipping of the Creator, it is the sustainance of evil, the blue print of pagan worship or the tokoloshi initiation rite, what do you expect out of such worshippers? You of course expect them to call elders embeciles.

It's unfortunate that you just want issues swept under the carpet because one is an elder. In our culture, Shona culture, there is a saying,' Gudo guru peta muswe kuti vapwere vagokuremekedza". In essence it implores elders to behave in a respectful mannerr in order for them to earn respect from youngsters. In the case of Malinga, (1) He breaks the law (2) He is given a change to do things right, by being asked to park properly (3) He responds with an insult (4) He is taken to superiors of the police to explain himself (4) He maintains his foul behaviour! Do you really think he deserves that respect?
He threw away the priviledge of being called an elder and treated as such. He now simply an old person, I am afraid to say a stupid one too!
That sort of respect will not be due to him for as long as he behaves like a spoilt brat! If he was an elder worth his salt, he should have (1) respected the traffic lawa (2) respected the office of the policeman (3) refrained from tribalistic attacks (4) apologised, like a true elder.
I still maintain, he is an imbecile, by way of his behaviour! Christianity or African culture does not call for people to respect fools. The bible is full of verses berating fools and foolish behaviour, similarly our culture does the same!

Aha I get you now because there is nothing like Ndebele culture or Xhosa culture or Shona chlture, it is the "whiteman" who taught that bantu are as different as mercury and a rock rabbit. Bantu are family who originate from founding African fathers who were brothers, so when you and Mokoena and others start calling each other tribal insults, I freeze with resignation.
True Nswabanda that "Gudo guru peta muswe kuti vadiki vakutye", and if the elder refuses to fold his tail, have you heard of young baboons teaming up to dethrone the senior? Else perhaps you modify the proverb "Gudo guru peta muswe kuti vadiki vakutye, asi kana raramba kupeta muswe, vadiki tyorai muswe uyoyo"!
I am not saying baba Malinga did well, I am insisting that in calling him imbecile you erred within the provisions and confines of African culture and I repeat that you withdraw that insult from the elder and call me donkey. Or else it has to be the Christian spirit of Jesus that causes you to violate such taboos.

I cannot comment on "African Culture" I am Shona and thats the culture I know and understand best. I cannot comment on Tswana culture, Zulu culture etc! I will not try to relate to that which I have no intimate knowledge of! There are quite some significant differences in cultures from different African groupings!
As for Malinga, what is he teaching the young people? If a Shona speaks to you in Shona in Bulawayo he is becomes stupid? Is that what you defend? If a Ndebele guy asks for directions in his language whilst in Mutare he becomes stupid? Are you that naive to call it a mistake by Malinga? What he demonstarted was outright stupidity and it is not a mistake to call him such because he vehemently insisted. By so doing he has cast aside the reverence he is supposed to receive as an elder! He is plainly an old human being!
I may have been too harsh in calling him an imbecile, that I withdraw, but his behaviour was plain stupid! Its not the first time Malinga has spoken tribal sentiments, he is fond of that and it diminishes his stature in the eyes of the nation. I have personally worked with him and his attitude to wards non-Ndebel blacks is just plain arrogant. He even refuses to be served by them, be it at the police station or wherever. People often just respect his disabilty and do not cahllenge him, but i feel he is getting too big-headed! He should be reduced to his proper lever and earn the respect!

I am not defending baba Malinga's conduct. I am saying its wrong to insult an elder nomatter what. When I advise you to withdraw your insult without any further comment like "I withdraw, but his behaviour was plain stupid", I am trying to redeem you from a low moment of your life. But should you want to live in that deep, suit yourself.
African culture for the record is one. What has happened to African people is that as they separated into tribes and adjusted to different habits, some maintained one aspect of culture and some dropped certain aspects. Its like the alphabet A-Z, its called so in its entirity but if you visit a grade one class John may know a to j Sarah may know s to z and from that you do not begin to call those John and Sarah alphabets and begin to say they are distinct.
And with the bantu dialects, some words were lost when some tribes moved from places without manifestation of those objects. Some new words were gained when a new object appeared. Your London children probably do not know Tsubvu, or bira, or dzimbahwe because such aspects may not be there in the diaspora. At the same time they may have picked certain things linguistically or culturally like sodomy because they see it in full throttle among the people of the north.
