Tsvangirai MDC leadership prolonged indefinitely

THE MDC has dropped from its constitution a clause limiting the party president’s terms in office, thus extending Morgan Tsvangirai’s possible tenure to beyond 2011.

In what sources in the party said was an unconstitutional move, the MDC removed clause 6.1.3, which said the president shall serve for a maximum of two terms.

The sources said no amendment was brought before the party’s last congress in 2006 to remove the limit.

Also missing from the constitution is clause 6.2.2, which also limited the terms of the vice-presidents.

According to the MDC constitution, any amendment to the constitution requires approval by at least two-thirds of delegates present and voting at congress.

Our correspondent is in possession of the two versions of the constitution, the 2000 one and the other printed in May this year, which is being distributed to party organs.

According to the 2000 constitution, Tsvangirai was supposed to step down in 2011, paving way for his successor to take over.

What the new amendment means is that Tsvangirai will decide when he wants to step down.

Constitutional lawyer, who was co-author of the 2000 MDC constitution, and a close MDC ally, Lovemore Madhuku, said Tsvangirai would remain in office until he chooses to step down.

“There is no chance of Morgan Tsvangirai being replaced in the MDC unless he steps down. Don’t expect anyone in the MDC to challenge him,” Madhuku said.

“The MDC will not have a change of leadership any time soon. We will have no leadership change in Zanu PF and no leadership change in MDC, but might have a scenario of disillusioned members from both forming their own party.”

While Madhuku was criticised for extending his term as chairperson of the National Constitutional Assembly by amending the assembly’s constitution, he said at least it was done before their congress not like what happened in the MDC which never brought it before the people.

An MDC top official, who preferred not to be named, confirmed that the amendment was not brought before the 2006 congress.

He said some people proposed at an executive council meeting before the congress that the clause be brought before the people for amendment but Tsvangirai said it should be left as is.

“Tsvangirai didn’t want to come out as if he is trying to hold on to power. Bringing it before the congress would have raised a lot of debate and they were worried that it might attract negative debate,” the official said. “However, the president now no longer has terms. It was not amended by the congress. This is complete thuggery. There is a current constitution which they are distributing and that clause was simply left out. It was simply chopped off — it was a matter of ‘highlighting, copying and deleting’ the clause. Unless you have a copy of the 2000 constitution with the clause 6.1.3 stating that the president shall serve for a maximum two terms, it’s as if it never existed.”

The sources alleged that MDC secretary general Tendai Biti printed the current constitution “under duress”.

Biti and party spokesperson Nelson Chamisa could not be reached for comment last night as they were out of the country on government business.

The MDC has been hit by reports of infighting with some alleging that Biti is trying to upstage Tsvangirai.

The source said Biti and his people want Tsvangirai to take them into government first and then take over from him as head of a party in power.

The sources said a recent document on the party’s positions on the constitution-making was also doctored after a pro-Tsvangirai camp in the MDC executive rejected a proposal by Biti that the state president should be elected by parliament. This, the sources said, was changed to say the state president should be in office through popular vote.

The document was circulated to MDC MPs a fortnight ago who fumed and questioned who the author was because they were not consulted to make their submissions.

While Chamisa admitted to an online publication recently that the president’s term was no longer limited, he seemed to contradict himself.

He said the constitution speaks of two-five-year terms without necessarily speaking of limiting people in terms of their offices.

“We insist that the terms of office in the party are supposed to be five years, then you go back to elections. But in terms of government, we have said those who should serve government, they should serve a maximum of two terms,” Chamisa was quoted as saying. “Meaning to say that if someone gets into office as president, like President Tsvangirai, he will serve a maximum of two five year-terms each to have the 10 years as president. It’s the same thing for all cadres. That is the position that is clear in the constitution of the MDC.”

At the second MDC congress in 2006, Tsvangirai promised to hand over power once Zimbabwe was restored to full democracy.

“It has never been my intention to hold on to power after the people liberated themselves from this dictatorship. My contract with the people does not extend beyond a certain time-frame,” said Tsvangirai. “A new Zimbabwe, a new beginning has no room for life presidents. My wish is to execute our mandate in an honest and vigorous manner: preside over a transition to full democracy and pass on the baton to another Zimbabwean. I believe there must be an exciting life for a pensioner — whether that pensioner is a peasant, former factory cleaner or a former president. I pledge to honour my word.”

Tsvangirai ndizvo. We can't talk of replacing him now, otherwise we will be reversing the wind of change change that has already gathered. Tsvangi has been fighting, arrested, beaten, exiled,hidden(in embassies) therefore he deserves to lead us for now.

You see now, this is why we say Zimdiaspora is anti-Tsvangirai, it reports everything for MDC-T in a negative way, that is why we do not want the Mtombeni brothers and Jameson in the MDC UK, coz they get all the credit at this site. This site and Sunday mail, Chronicle and Herald are the same. I bet this article was sent to Zimdiaspora by the guys I mentioned above. I stand to be proved wrong

It is quite disturbing to learn that MDC-T has taken a leaf from ZANU PF’S constitution and that means we are going to be stuck with Tsvangirai for the rest of his life. In MDC-T we are we voting ZANU PF the only difference being head and tail of the same coin.

Why can't people be given chance to decide what they want. Why are we told what to do. Variety is the spice of life. We have people out there who can do better than Tsvangirai. Let us give them chance.

People originally from the north are prone to life presidency. Look north and read history. Think about all north african leaders you know and how long they have been in power.

Think about the south and how respected and short the leaders are. Think about the gnashing of teeth in the north and think about the wealth and health and prosperity in the south. Think about the pompority in the north and humility in the south. IF I AM LYING TELL ME TO SHUT UP. But if l its true, remember Tsvangirai is same northern seed and so are his genes. He knows what is healthy for the country but also he wants a title for himself. ITS HARD TO LET GO.

You are lying, shut -up! The south you refer to is only south Africa, but still they elected a dubious leader, who sleeps around despite having 5 wives, he eascaped a corruption trial through a technicality! So what are you saying? Is that exemplary? Tsvangirai's mandate was extended by the MDC people. He did not extend it for himself! They see his leadership qualities! What MDC say is that when in power, they will limit the presidential term, not the party terms! ZAPU was lead by JMN for ages coz they repected his ability to lead! Nothing wrong with that!
As for Myekeleni Manzini, you just criticise for the sake of it, you dont have facts! Its not a question of individuals doing better than others! No! Its a collective effort my brother! Who are those nameless people anywhere? O Ralph Mguni and Ryton Dzimiri?

Reporter Zaba must be a southerner and commentor Pius a northerner. People from the north do not see anything wrong with life president and people from the south will never keep one men for too long.
Every comment after this one will show you which side of africa ones mentality is adapted to.
Reasons like that are what drove me to take the Zapu mentality although I am originaly a northener of the Mbire dynasty.

Its very sad whats happening in Zimbabwe. Even those Zimbabweans who have lived in pure democracies seem not to have learnt anything. Shame. Is it in the DNA or lack of mental development or failure to develop from stone age attitudes. Shame. In 1980 Shonas said Mugabe must rule for ever. Its there in youtube. Today Shonas are saying Tsvangirai must rule for ever again. Its very sad indeed. Mugabe started employing his relatives in high places, Shonas said its fine, now Tsvangirai has unashamadly appointed his direct uncle Makuvise as ambassador designate to German, Shonas are still saying carry on. Imagaine if it was Gordon Brown doing that? What kind of Zimbabwe are we going to hand over to our grand children, perhaps our grandchildren will look back and say we were very stupid. Its not about Tsvangirai its about social justice.

Have you heard of a country called Mozambique where Northern minded Zimbabweans flood the boarder scrounging for fortune? what about Botswana? What about Namibia?those are southern african natives. They think southern and l am a northerner.
The kind of life style l would offer Zimbabweans if l were to rule would not be different from Libia, somalia,tanzania,zimbabwe,DRC, Angola,rwanda.

Democracy is not easy to achieve, it takes cultural renovation. UNLESS YOU LEARN TO ADAPT TO THE DIFFICULT SACRIFICES IT DEMANDS, YOU WILL ACHIEVE HALF BAKED DEMOCRACY THE MODEL OF ZANU.

Its really hard to believe that people write in this forum purporting to be 'thinking big'. Its not big enough if you think people in power should not be subjected to some election process. Tvsangison should pass the button. Let me tell you the truth. He has done quite well. There are other people in MDC who can do equally well if not better. Dont let MDC become ZANU. We want debate, good governance and that is demonstrated at party level. We may hate or ignore parties, but its the same people who become our presidents. If MDC wins, the man will be my president even if I am not an MDC supporter. Bantu be MDC, think deeper, you may love the man, but dont do it blindly. MDC would have won the last election if Tsangi didnt cause that split. Now come in ZAPUUUUUUUUU! PUZAAAAAA. Zathelekana. Wait and see mature politics in Zim. Zapu will teach these parties what good politics is. I am reliably informed that ZANU is cracking more following the formation of ZAPU. MDC weshiiiiiii. That is not rudeness, its open debate. We can have tea on these debates, no insults, no anger. My next door neighbour is MDC and I am obviously ZAPU. We are good mates. He is considering joining ZAPU like all others who have pulled out because of a convincing message form ZAPU. Ndizozo vana bebvu. Politics at its best yasvika kuZim.

ZANU and MDC are bound to fail in future because of porous constitutions and dictators at the top.

i think Tswangirayi should carry on for now for the sake of continuity. He needs to oversee the transition of power from Zanu, in which he has played a major role and paid a huge sacrifice. It is not the right time to be making big changes as this will only weaken MDC's strategy and distabilise the party before the elections which would be playing into the hands of Zanu.

In a democratic society a person is allowed to talk and express himself or herself. Leaders can be criticised for wrong doings. Beatings, imprisonment and arrests does not garrantee a permanent position in the party. If you say changing the leader before achieving the final goal might cause problems can sound not all that rubbish. Condomised minds will create another Monster. freedom of speech is God given you can't stop people to talk what they want and when they feel. Robert was not like this but people made him to be like what he is because of worship him. where are we now. Be careful.

I do not agree with constitutional changes to perpetuate individual rule. Whether its Mugabe, Joshua Nkomo, Ndabaningi Sithole, Abel Muzorewa, Ian Smith, Morgan Tsvangirai et al LEADERS FOR LIFE. I so so detest this. we cant talk of other fringe, small and perhaps irrelevant parties because they are not ant different.

It’s really sad to see that Tsvangirai is swiftly developing into a Mugabe within short period of time. I personally think this is a serious matter of principle. Constitutions should be followed and they not be tempered with, to suit certain individuals. I really despise such actions which can be interpreted as “no one can lead MDC except Tsvangirai and actually equates to ZANU and Mugabe”. The message we seem to be getting from these political parties is that rules are not binding and they should not be followed, so why make them for a start?

Like I have always said before that MDC is either a youth wing of Zanu or they are actually worse than Zanu.If you give them about five years everyone will be able to see how bad Morgan is as a leader.First it was Sekai Horrand uttering tribalist statements and Tswangirayi didnt do anything to her.Secondly it was Sipepa Nkomo (the one that stole MIPF funds with Trevor Carelse-Jul) just attacking ZAPU and Joshua Nkomo and now he has made himself the Life President.Even the DA in South Africa is more democratic than MDC.Look at how Tony Leon served his term and left the leadership to Helen Zille.

Some people are so narrow minded that I fail to understand who run their own home that is if they have homes. Nswabanda is failing to comprehend why we say Tsvangirai has done well in coping his uncle Mugabe. He has done his term and must go. The constitution MDC-T is using was drawn by MDC-T and I am sure that the TWO TERM CLOSE was put after careful thinking and was approved by two third or more voting majority MDC-T congress. What is happening now is unconstitutional and is violation of own constitution by the leadership and people like Nswabanda think it is progress and continuity. The devil we know culture must be done away with because MDC-T must surely have many potential candidates who are capable of continuing the work Tsvangirai started.

I do not want to believe that Nwsabanda is suggesting that Tsvangirai is the only candidate who knows what he is doing and the rest are simple followers. The party must be bigger than members for it will alway be there long after Tsvangirai has gone.

This article seeks to cause disharmony among the MDC leadership unfortunately we are aware of all ZPF tactics. 2000 MDC constitution is dead and buried, the xtra-ordinnary congress of 2006 ushererd in a new constitution which we all have. No such limit on the terms of the President or any other cadre who holds a position. Anyone interested in the position should present him/herself at each congress and contest for any post he/she wants.

Nothing new under the sun. they said in the last twenty years no one can be president except Mugabe and everyone feels the results. Today no one can be president in the MDC except Morgan. Bathong!!! Disaster I think its inferiority complex or my people have been opressed for too long. I remember some people maintaing that no toher person could be a headmaster at a certain school except one old man. One day they brought a twenty-eight year old graduate. Pass rate increased, infrastructure improved. Now i understand why Welshman and them lost the party.

it sounds bad but the intentions might be good
i mean Tsvangirai sacrificed almost everything for a more democratic Zim, imagine after being beaten, arrested, almost murdered numerous times, losing your wife, only to watch someone else lead change that you fought for and sacrificed everything for. maybe he just wants the transition and then he quits like nelson mandela. then he could become another african statesman

I've just checked the MDC Constitution. I can't see anywhere in it that the president of the party is the only person eligible for the Prime Minister or even Zim President role. It would send a very strong message that MDC is a party of excellence (as they keep saying) should they stick to their constitution. It also would silence the doubters who see another Mugabe on the rise.
